Proview sued by its iPad court case law firm, owes 2.4 million dollars in legal fees

Guess who's hasn't yet gotten its share of Proview's recently acquired $60 million? Ironically, it's the lawyers that helped it win the iPad trademark dispute in China. According to Sina Tech, Grandall Law Firm confirmed that its shady client refused to pay up the promised 4 percent of Apple's settlement fee, which equates to $2.4 million. While acknowledging their contractual arrangement (wherein the law firm covers the legal fees in advance, and then expect the client to pay up after winning the case), Proview founder Yang Rongshan told Sina Tech that Grandall's behavior is "nonsense," and that his company isn't obliged to pay back immediately as it isn't under normal operation right now. However, Yang promises Proview won't "pass the buck." We shall see about that.

With its summer break fast approaching, calls are mounting for the U.S. Senate to put politics aside and act on nominees for long-empty judicial seats, including two in Utah?s federal court system.

On Thursday, American Bar Association delegates from Oklahoma asked that state?s two senators to press for a floor vote on appointment of Judge Robert Bacharach to the 10th Circuit Court of Appeals, which also hears appeals for Utah, Colorado, Kansas, New Mexico and Wyoming.

The judicial vacancy crisis

Glenn Sugameli, a staff attorney whoever oversees a federal judicial nomination project for Judging the Environment, said the Senate could easily act ?tomorrow? on the dozen or so federal bench nominees with unanimous support from its Judiciary Committee.

?There are plenty of examples in the past when there were votes on a bunch of people at the same time,? he said. The Senate acted on 10 district court nominees during a single vote in September 2008, for instance ? including some who had committee hearings days earlier.

?Clearly there can be, should be and has been Senate action in presidential years to confirm consensus nominees well into September,? he said.

President Barack Obama nominated Bacharach, a magistrate judge for the Western District of Oklahoma, on Jan. 23 and the Senate Judiciary Committee on June 7 gave the judge virtually unanimous support ? Utah Sen. Mike Lee?s symbolic "no" vote aside.

"We understand that both political parties have engaged in a variety of stalling tactics, including the threat of a filibuster, regarding judicial nominations in the past," the delegates wrote to Senators James M. Inhofe and Tom Coburn. "However, this ignores the fact that this Oklahoma slot on the Tenth Circuit has now been vacant for over two years."

But with confirmation votes on such nominations moving at the rate of one a week, any action on the 21 federal court nominees pending in the Senate before the August recess appears unlikely, especially with the Senate minority leader vowing to block further federal circuit court vacancies under the so-called "Thurmond Rule."

And that is baffling to some court observers.

While it has long been opposing party practice to stop the judicial nomination process in the spring preceding a presidential election, there is typically an exception for nominees with "an unusual degree of unanimous support," said Michael McConnell, director of the Stanford Constitutional Law Center and a former 10th Circuit Court judge representing Utah.

"Judge Bacharach has such strong support and such a good reputation across the spectrum that I am hoping that he will be the exception that does get confirmed, even in an election year," McConnell said Thursday. "But Washington is a pretty political and partisan place these days, so who knows?"

In a move highlighting how the process has stalled, the Senate on Monday confirmed Kevin McNulty to New Jersey?s District Court but will not consider a second nominee, Michael A. Shipp, to the same district until July 23, when a cloture vote is scheduled. Both nominations, which received virtually unanimous support from the Senate Judiciary Committee, have been pending in the Senate since April.

Sen. Patrick Leahy, D-Vermont and Judiciary Committee chairman, said the minority?s "stalling votes on judicial nominees with significant bipartisan support is all to the detriment of the American people."

"What they are doing now is a first," Leahy said. "In the past five presidential election years, Senate Democrats have never denied an up-or-down vote to any circuit court nominee of a Republican president who received bipartisan support in the Judiciary Committee."

As for the district courts, six of 13 nominees awaiting Senate confirmation are considered judicial emergencies based on existing case loads and length of time seats have remained empty. Among them: Robert J. Shelby, nominated eight months ago to fill a post in the U.S. District Court for Utah vacated when Tena Campbell took senior status in January 2011. Shelby, like a majority of the other district court nominees, received unanimous bipartisan support from the Judiciary Committee; the committee approved Shelby in April.

"Really you are in a situation now where it really is unprecedented in the extent of the obstruction," said Glenn Sugameli, staff attorney with Judging the Environment, which keeps watch on federal judicial nominations. "It makes no sense. It is even hard to figure out what the motive is at this time, other than to deny confirmations. I think they are clearly trying to leave a lot of these seats open for a different president to fill."

McConnell, however, said while that is not a good practice, "it is not a new practice." Nor is the process slow only in election years. In his own case, McConnell, nominated by President George W. Bush in September 2001, waited 19 months before the Senate approved his confirmation in November 2002.

"I do think it is unfortunate that the Senate has gotten into this habit of holding up confirmations in election years, but I don?t know that it is any different this time than it has been in the past," McConnell said. "The whole judicial confirmation process has become a mess. It takes too long and it?s become acrimonious."

Mark Jones, court clerk for Utah?s District Court, said the four senior judges hearing cases ? two are still carrying a 60 percent case load ? have helped the court keep pace with filings, despite recent vacancies.

Fred Willard Fired by PBS, Issues Statement

In light of his, ahem, embarrassing arrest, Fred Willard finds himself without a steady job.

The 78-year old actor, who was booked last night on charges of lewd conduct when police caught him with his pants down in a movie theater, has been let go as the voice of PBS's Antique Rainbows spinoff, Market Warriors. 

The veteran actor's attorney, however, has issued a statement proclaiming his client's innocence.

"With all due respect to the individual officer, our belief is that Fred did nothing in any violation of any law," Paul Takakjian tells TMZ. "We will be working vigorously to clear his name in this matter."

In the meantime, can someone please buy this man a big screen TV and a DVD player?

When we plan events or look to order dif?fer?ent beers I try to edu?cate as many peo?ple as I can about those beers and expose them to dif?fer?ent beer fla?vors and styles that they may not be used?to.

ScienceDaily (July 16, 2012) ? As organisms develop, their internal organs arrange in a consistent asymmetrical pattern -- heart and stomach to the left, liver and appendix to the right. But how does this happen?

Biologists at Tufts University have produced the first evidence that a class of proteins that make up a cell's skeleton -- tubulin proteins -- drives asymmetrical patterning across a broad spectrum of species, including plants, nematode worms, frogs, and human cells, at their earliest stages of development.

"Understanding this mechanism offers insights important to the eventual diagnosis, prevention and possible repair of birth defects that result when organs are arranged abnormally," said Michael Levin, Ph.D., senior author on the paper and director of the Center for Regenerative and Developmental Biology at Tufts University's School of Arts and Sciences.

"The research also suggests that the origin of consistent asymmetry is ancient, dating back to before plants and animals independently became multicellular organisms," he added.

The work appears in the Proceedings of the National Academy of Science Online Early Edition publishing the week of July 16, 2012.

Co-authors with Levin are Joan M. Lemire, Ph.D.,a research associate in the Department of Biology, and doctoral student Maria Lobikin, also in the Department of Biology.

Tubulin Proteins Operate Across Species

Up to now, scientists have identified cilia -- rotating hair-like structures located on the outside of cells -- as having an essential role in determining where internal organs eventually end up. Scientists hypothesized that during later stages of development, cilia direct the flow of embryonic fluid which allows the embryo to distinguish its right side from its left.

But it is known that many species develop consistent left-right asymmetry without cilia being present, which suggests that asymmetry can be accomplished in other ways.

Levin's team pinpointed tubulin proteins, an important component of the cell's skeleton, or cytoskeleton. Tubulin mutations are known to affect the asymmetry of a plant called Arabidopsis, and Levin's previous work suggested the possibility that laterality is ultimately triggered by some component of the cytoskeleton. Further, this mechanism could be widely used throughout the tree of life and could function at the earliest stages of embryonic development.

In their latest experiment, the Tufts researchers injected the same mutated tubulins into early frog embryos. The resulting tadpoles were normal, except that their internal organs' positions were randomly placed on either the left or right side.

In subsequent experiments, collaborators at the University Of Illinois College Of Medicine and Cincinnati Children's Hospital Research Foundation found that mutated tubulins also have the same effect on left-right asymmetry of the nervous system in nematodes and on the function of human cells in culture.

Altogether, the Tufts experiment showed that tubulins are unique proteins in the asymmetry pathway that drive left-right patterning across the wide spectrum of separated species.

Importantly, mutated tubulins perturbed asymmetry only when they were introduced immediately after fertilization, not when they were injected after the first or second cell division. This suggested that a normal cytoskeleton drives asymmetry at extremely early stages of embryogenesis, many hours earlier than the appearance of cilia. Further, the Tufts biologists found that tubulins play a crucial role in the movement of other molecules to the left and right sides of the early embryo.

An Understanding of Birth Defects

"What's remarkable about these findings is that the same proteins are involved in establishing asymmetry in organisms as diverse as plants, nematodes, and frogs, and they even affect symmetry in human tissue culture cells," said Susan Haynes, Ph.D., of the National Institutes of Health's National Institute of General Medical Sciences, which partially funded the work. "This work is a great example of basic research that not only illuminates fundamental developmental mechanisms, but also increases our understanding of a class of serious human birth defects."

Fed, Congress fiddle as economy stumbles

There's no shortage of finger-pointing over whose job it is to save the U.S. from slipping back into recession.

Federal Reserve Board?Chairman Ben Bernanke told a Senate panel Tuesday there's little he can do to offset the likely economic damage if Congress steers the U.S. economy over a fiscal cliff. Nor, he told lawmakers, is that his job.

"I don?t think that?s my responsibility," he told the Senate Banking Committee. "I've been assigned to focus on maximum employment and price stability, not to hold threats over Congress? head. Congress is in charge here, not the Federal Reserve.?

But with Congress deadlocked in an election?year and unable or unwilling to head off a?package of massive tax increases and spending cuts that threaten to snuff out the faltering U.S. recovery, it's not clear who's in charge.

?We can talk all we want -- everyone gives speeches how fiscal policy should be the way to go and we don't do anything," Sen. Charles Schumer, D- N.Y., told Bernanke. ?Given the political realities, Mr. Chairman, particularly in this election year, I am afraid the Fed is the only game in town. And I would urge you to take whatever actions you think would be most helpful in supporting a stronger economic recovery.?

Bernanke?s semi-annual briefing to Congress, watched carefully by businesses and investors, was expected to bring hints of the central bank?s next move to stave off the latest slowdown in the U.S. economy. Since the financial panic of 2008, the Fed has taken a series of steps to push cash into the banking system to lower interest rates and to spur borrowing and investing. ??

For a time, it looked as if those moves could offset the economic damage inflicted by the worst financial collapse since the Great Depression. Last winter, as job growth picked up and the housing market appeared to stabilize, the Fed seemed to have succeed in its ?dual mandate? of managing the supply of money to promote job growth and keep inflation in check.

But this spring,?the economy?s?momentum began to fade. Job growth has slowed. Consumers are pulling back on spending. Corporate profit growth is slowing. Economists have begun paring back their growth estimates for the rest of the year. Only inflation seems tame, as long as gas prices remain relatively cheap.

The latest data has fueled speculation that the Fed may soon announce another round of cash injection, possibly through the purchase of mortgage bonds to help spur lending to boost home sales. But after pumping roughly $2 trillion into the system, and with interest rates already near zero, some Fed watchers caution there may be little left Bernanke and his central bank colleagues can do to revive growth.

?Monetary tools are not unlimited in their effect,? said Dino Kos, an analyst at Hamiltonian Associates and a former New York Fed official. ?You can't achieve all objectives through managing money. And this is what we're finding out.?

To make the Fed?s job even more impossible, Congress has set in place fiscal policies -- locking in massive tax increases and spending cuts -- that are set to kick in abruptly at the end of the year. Unless diffused, those measures will lop as much 5 percent off the growth in gross domestic product within a matter of months, according to economists.

It would also send the job market back into contraction. Bernanke cited Congressional research estimating the full package of tax increases and spending cuts would destroy about 1.2 million jobs. And that forecast doesn?t take into account the wider turmoil if Congress embarks on another self-inflicted financial crisis like last summer?s debt-ceiling debate that created the ruinous fiscal policy in the first place.

?As you recall, market volatility spiked and confidence fell last summer, in part as a result of the protracted debate about the necessary increase in the debt ceiling,? Bernanke warned the Senate panel. ?Similar effects could ensue as the debt ceiling and other difficult fiscal issues come into clearer view toward the end of this year.?

To some Fed watchers, Bernanke and his colleagues have accomplished what they set out to do. Though credit is still tight for many borrowers, U.S. banks are in much better shape than they were in 2008 and much stronger that their European counterparts. The housing market,?still languishing at recession levels, appears to have stabilized. Though the economy remains weak four years into recovery, it has so far avoided the double-dip contraction that is now sweeping Europe.

Michelle Meyer, BofA Merrill Lynch Global Research and Robert Heller, former Federal Reserve Governor, provide an outlook on the economy.

Now, with growth slowing?again, the biggest obstacle to recovery has become the widening uncertainty gripping business and consumers over the fallout from the paralysis in Congress. ?

?How can monetary policy at this point offset the uncertainty about whether or not we get a $400 billion to $500 billion tax increase in 2013?? said John Ryding, chief economist at RDQ Economics.

Even if Congress steps back from the ?fiscal cliff? following the November election, the Fed has even fewer options in dealing with the more immediate threat of the U.S. economy from the ongoing slowdown in Europe. On Monday, the International Monetary Fund lowered its forecast for global growth, citing the continued inability of Europe?s leaders to come to grips with the slow-motion unwinding of the eurozone.

For more than two years, European leaders have been struggling unsuccessfully with a deepening debt crisis that is now threatening Europe?s banking system. Weeks after agreeing to a 100 billion euro ($122 billion) bailout of Spain?s banks, finance ministers are still haggling over the terms. On Monday, Germany?s highest court postponed until September a decision on whether the bailout fund itself violates the country?s constitution. ??

But Spain?s bankers may not be able to hold out that long. As investors and depositors become increasingly skittish, Europe lacks the political and governmental infrastructure to backstop its banking system and quell a panic the way the?Fed, Treasury and Congress did in 2008 with programs like the $800 billion Troubled Asset Relief Program. ?

?There is no TARP, or any meaningful policy response in Euroland,? Carl Weinberg, chief economist High Frequency Economics, wrote in a note to clients. ?We therefore expect the crunch to be deeper than in the United States ? where it was plenty deep enough.?
